1. Agreement to Terms

By accessing or using Control Horizon (“the Service”), operated by Arcbene Pty Ltd (ABN available on request), a company registered in the Australian Capital Territory, Australia, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Control Horizon is a web-based project risk management application that provides risk registers, heatmaps, sensitivity analysis, control tracking, and related tools. The Service is provided on a software-as-a-service basis with free and paid subscription tiers.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us immediately of any unauthorised use.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorised access to the Service or its systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Use automated tools to scrape or access the Service beyond normal usage

5. Your Data

You retain ownership of all data you enter into the Service. We claim no intellectual property rights over your content. You grant us a limited licence to host, store, and display your data solely for the purpose of operating the Service.

You may export or delete your data at any time. Upon account deletion, we will remove your data within 30 days, except where retention is required by law.

6. Payment and Subscriptions

Paid plans are billed monthly or annually as selected at the time of purchase. Prices are in Australian Dollars (AUD) unless otherwise stated. We may change pricing with 30 days' written notice. You may cancel at any time; access continues until the end of the billing period.

7. Availability and Support

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance with reasonable notice. Support is provided via email on a best-efforts basis for free plans and with priority response for paid plans.

8. Limitation of Liability

To the maximum extent permitted by Australian law, Arcbene Pty Ltd is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability is limited to the amount you have paid us in the 12 months preceding the claim.

The Service provides tools for risk management — it does not constitute professional risk advice. You are responsible for decisions made using the Service.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, to the extent permitted by law. We do not warrant that the Service will be error-free, secure, or available at all times.

10. Modifications

We may update these Terms from time to time. We will notify you of material changes via the Service or by email. Continued use after changes constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the Australian Capital Territory, Australia. Any disputes will be resolved in the courts of the ACT.
